i didn't create anything. i just found it. there is a nonzero chance that many other people found it before me


in my case this is less common than one might expect. i do quite often find connections that nobody around me has ever heard of or thought of before.


BUT i have lived in this mind so long that it is very hard for me to gauge, in the absence of other viewpoints, when that's gonna be the case

So, sometimes I'm nervous about what will happen in upcoming Canon for my fandoms, because of what it might do to fandom discourse and the overall dynamic of who's a fan and how they interact...


BUT I am... pretty apathetic about it from an in-universe perspective.


because... Canon is, in my mind, just as fictional as fanfiction. Bad Canon means, to me, that a really popular big-name fan wrote a fanfic I don't like. If lots of fans are treating this writing as having More Authority on everything in the made-up world than the fanfics I like... well I'm just gonna ignore that and keep reading the ones I like, ok?


the oldest and most natural form of fictional storytelling... the form that our minds are arguably best suited to engaging with... is the in-person, spur-of-the-moment making-shit-up-for-the-hell-of-it. Children pretending. Elders telling tales around the campfire.


Grandpa tells the story of Paul Bunyan and says the Great Lakes were formed from the footprints of Babe the Blue Ox. Dad retells the story and says no, the ox is even bigger than that, the Lakes are its sweat drops. hell yeah! the kids each pick which version they like better. neither is The Truth.


honestly if you try to find this form of storytelling in Tumblr fandom, it's in Goncharov, and it's in the space adventures of Stabby the Roomba.


there's a person who was the first to introduce Stabby the Roomba! we can find this person's tumblr account with only a little digging! but do we run to that account's askbox to confirm whether each new story about Stabby's adventures is true or not?


NO. we do not. It's STORYTELLING.

Yeah, I mean, as I see it, the competition is the reason WHY one would have a problem with others profiting off one's IP. Like, if I create something and then someone else is profiting from it, that reduces the amount I can profit from it... because people have limited money to spend. (Which I guess is why unpaid fanworks are okay, because like I said they don't actually compete; they don't take money that people could be paying the original artist.)


But I dunno... the fair use thing is hotly debated and I'm not gonna claim I understand it completely.


And from what I can see, neither does most of the U.S. legal system. What can get ruled (in a court case) to be valid fair use seems to depend entirely on the court and the judge and perhaps their current mood.


From what I've read, the idea of fair use was introduced to allow certain important types of commentary.


One example is quoting a piece of writing when you're doing journalism and that piece of writing is a relevant piece of evidence in the story. (I remember a time when some shady "news" outlets tried to challenge this, suing for copyright infringement whenever anyone tried to point out lies in their broadcasts. Luckily they failed for the most part, and this type of commentary is very much accepted as fair use now.)


Another example, of course, is parody. We had socially accepted parodies long before fanfic was considered legal. Usually they would change names to be safe (like when MAD magazine would do a whole comic-format spoof making fun of a popular movie, renaming Ferris Beuller to "Fearless Buller" and so on). But in some cases they didn't even bother with renaming. (I remember a Far Side cartoon featuring the crew of the Starship Enterprise, which was explicitly called the Starship Enterprise in the comic, no attempt to rename it.) I remember thinking about this, as a kid in the 90's, wondering why jokes and mockery seemed to be the only legal type of copyright infringement.


The OTW has done a lot of legal fighting since then to get fanworks accepted as valid fair use. The type of nonprofit use that happens on Ao3 doesn't tend to get challenged in court anymore. But it's still not accepted on the same level as MAD magazine parodies or SNL spoofs, because it's still generally considered infringement to make money off that.


When I try to decide whether I consider something fair use, my usual thought experiment is to put myself in the shoes of the copyright owner. Like:


If I made up a whole imaginary world, populated by my own OCs... and then I published and sold my own stories about it, in the form of novels and comics and so on... what type of fanworks would I be ok with?


How would I feel if someone used my OCs or my original world in their own writing or art, without asking for my permission?


Would the answer change depending on what type of work it was-- written or visual?


Would it depend on whether and how they gave me credit?


Would it change based on whether or how they made a profit from it?


Personally, for me, I would be okay with any of it, AS LONG AS I was credited for whatever ideas were taken from my work.


Monetizing would be okay, from my viewpoint. (I'd be feeling a deep sense of unfairness if the fan creator was making MORE money off my ideas than I was. But I'd accept that this probably meant they were contributing something valuable of their own... and I'd still consider it good publicity, as long as they made it clear where the ideas came from.)


For me, the only thing that would get me actually fighting would be if someone used my ideas WITHOUT crediting me. (And even then, I'd do some deep analysis of whether the ideas were really my property, or whether the other person might have just come up with something very similar on their own. There are limited ways a story can go, and minds tend to gravitate independently toward certain types of ideas, and I'm not going to challenge similarity unless it copies specific details in a specific way.)


But that's just my view. Copyright law in general is stricter than I would tend to be in defending my own copyright.


And what's socially acceptable within fandom can be both stricter and more lenient than actual law.


(More lenient when dealing with fanworks of properties owned by the rich and powerful, like Disney or Paramount. But stricter when dealing with the works of small, struggling artists, or ideas copied from one fanwork by another.)


(And to make it even more confusing, the exact line between "struggling artists" and "rich copyright owners" is also a topic of debate.)


(And I'm not even gonna get into the whole argument over how AI "art" programs are trained.)


(It's all just such a complicated mess, and I do not think it's possible to have a simple opinion on any of it.)

I've been thinking about how the idea that "fanworks are not made for profit" is a big part of the reason why they are usually not attacked for copyright and trademark violation.


(Which is why AO3 cracks down so hard on users advertising paid commissions -- because OTW worked hard to fight corporate lawyers for the right to share fanworks, and only won us the freedoms we have by promising that fanworks were not made for money.)


But the weird part is...


if the owner of the canon property is worried about fan art and fan fiction competing with their official material...


then, wouldn't being free make it much MORE competitive?


I mean, I don't know how often people will actually decide to read fanfiction and look at fan art instead of buying the canon book or movie or show or comic or whatever


But I'm pretty sure that, if it does happen, it's largely because the fanfic and fan art are free


so... ????


I mean, I'm guessing the reason they get way more litigious when there's profit involved, is the same reason why there's usually more legal red tape around selling something than giving it away free...


Which I think is mostly based around the fact that an activity will usually not become widespread enough to be a problem if it doesn't somehow make someone money


But there are exceptions.


There are things people will gladly put lots and lots of effort into, even if it doesn't bring in any money.


And fanworks are definitely among these things.


So in this case... is there any actual reason why for-profit fanworks would be more of a problem than nonprofit fanworks?


I guess maybe... people having limited amounts of money...


Maybe for-profit fanworks would compete with official material just because people might not have enough money to buy BOTH ...


I'm not sure how much sense this makes, but my understanding is it's not so much the competition that they're concerned with as much as other people profiting off their IP. Besides that, fanworks can get others into the original work, which serves as free advertising.


I know there's also fair use laws that go into this argument, but I am not as familiar with IP law as I should be.

Okay I LOVE it every time I see the suggestion that there should be a cooking show judged by young children, where every fancy snobby gourmet chef runs the risk of getting chopped and sent home with a scathing review of his work because "it's yucky and it has peas in it and peas are gross" or whatever


I think this would be utterly hilarious


But I think it'd be even BETTER if the framing for this-- the reason behind the show-- was an explicit claim that young children are inherently better judges than anyone else


Like the same reasoning we see in linguistic studies


Where little kids are asked how to say something, and their answer is taken as evidence of what is the objectively most natural way to say something, since their viewpoint is unspoiled by societal conditioning


I want the same thing for culinary judgment


An assertion that "the foods young children like best are the objectively best foods, because everything else is something society has to teach you to like"


Just take chefs with multiple prestigious degrees in cooking gourmet food, and tell them that based on a three-year-old's pronouncement, their magnum opus is inherently yucky and gross and nobody likes it unless they're tricked into liking it


I want to see the entire world of snobby food disintegrate under this chaos

As I understand it (correct me if I'm wrong)... "free" social media supported by advertising can (almost?) never be profitable, and the only reason any of the major social media sites have made money long enough to survive til now is by convincing shareholders that their value will increase in the future.


So theoretically, "purchasing Twitter and turning it into a paid subscription-based service with a much, much smaller (and stupider and eviler) userbase" might have *actually been* the only way to make it truly profitable.


But when you-know-who starts gloating about that, remember:


1. He's proven the truth that rich a-holes like him keep trying to deny: "ever-increasing profit isn't sustainable and sometimes a business getting smaller IS the only way to improve."


2. It is a failure of society that we ever got to the point where a profit-driven business was providing the only available online public square for a large percentage of people in this nation.

the news of "AI Art has been ruled uncopyrightable" feels mostly awesome to me but also sets off a slight uneasiness as to how they're defining "AI" and how/if that definition may get edited as time goes on


especially in the light of other news like "photos taken of the moon on smartphones get AI-enhanced without user's permission" and the question of whether I even have access to any non-AI means of making photos of my own handmade (hopefully copyrightable) art

That said...


as someone who is not a rich capitalist & therefore will never get more benefit from copyright than I get from "people simply being aware of my art"...


I expect I could sell my own original work with about equal success if it got forced into the public domain... and so I do not in fact care very much about being able to copyright it ...except as a means toward ensuring that someone richer and eviler doesn't steal it and claim they have copyright on it.


so... i dunno.

I don't usually think of age as a category of people identified by particular experiences (everyone's experience of every year of this world's past is vastly different) BUT I think I'm "unable to understand why a person who doesn't want a post reblogged would put it on the public internet" years old


if you say do not reblog on the post i will not reblog it but I'll wonder why its rebloggable in the first place and if you don't specify on the post i will have absolutely zero idea whether you do or don't want it reblogged because if i try to look at it from your perspective my conclusion will always be "they cannot want it to be private" "because if they did they would not have posted it on the Internet" and if i try to guess whether you have rules about only people of specific demographics reblogging it i begin to wonder how exactly your brain perceives both the publicness of the internet AND the semi-anonymity of its inhabitants

thoughts on the idea of "being unaffected by magic" in a magical universe


this is a dialogue from my WIP furry comic "Avery-Were" that's somewhere on one of my distant back-burners but i think about it every time i hear about a character who is "immune to magic"


"So, does being from a non-magical universe make me special here? Immune? Like, if I can't do magic, then I also can't be hurt by it?"


"Ha. No. And you wouldn't want it that way. Trust me."


"What? What d'you mean?"


"In my hometown, once, there was a child born cursed. His curse was being immune to magic. Unaffected by it. The curse came on as he grew. Got stronger and stronger..."


"...okay?"


"When he was five years old, magic barely did anything. Hurricanes sent by wind-magic couldn't blow him over. Boulders thrown with earth-magic passed through him. A magical plague caused a famine, he still had food to eat. Food that was intangible to everyone else."


"Whoa, damn. That's--"


"But it went for everything, see? The farmers used magic to grow food to end the famine. That food was intangible to him. His mother once used a spell to kill a bat-fly that was chasing him. It still kept chasing, biting him. Like a ghost she couldn't touch."


"...yikes."


"All of us children, we tried to play with him. But some children were born because of magic. Their parents met because of magic. Or could only conceive through magical means. I just re-read Isaac Asimov's "The Last Question," and I'm giggling at a probably totally unintentional meaning


so, this computer that gets asked the repeated question about whether entropy can be reversed...


over the centuries, it is named the Multivac, Microvac, Galactic AC... always the same two last letters, which in the text are said to stand for "automatic computer"


but they could stand for another machine that tries to fight against entropy


the little Maxwell's Demon that sits between inside and outside, eternally working hard to make one side colder and the other side hotter


what we today call an "AC"

Okay, I know we all laugh about how Tumblr used to let you edit other people's posts in your own reblog of them.


But honestly I think it may have been kinda good for people's critical thinking.


In the same way as how replies worked in newsgroups in the early 00's....


Which were basically like big multi-cc email conversations (and looked the same whether you got the posts by email or by going to a site like Yahoogroups).


So, "reblogging" and adding your own comments looked like it does in an email (a low-formatting email, not the current Gmail default which makes it hard to even SEE the words you're replying to, but that's another whole rant).

But, nobody did that!


The most editing I ever saw anyone do to someone else's words was shortening or paraphrasing for simplicity... and sometimes in a big and nuanced argument you'd get called out for that, because it can twist the context.


Nobody would do something like the above example, because it was just SO OBVIOUS that you could just go a few posts back in the thread and see what someone originally wrote.


You couldn't do it to trick people... and you wouldn't even really do it as a joke, because that would be like joking about something weird your friend said five minutes ago, when we were all in the room and SAW him say something that was 100% different from what you're joking about. It would be a type of absurdist humor that I don't think even Tumblr has reached in the present day.


But Tumblr HAS reached a point where we, in some cases, have an implicit trust in the user-interface which is really not that warranted.


And back when you could edit other people's words in your own reblog of them– and people were aware of that fact– that trust at least SOMETIMES got challenged, to keep us thinking.


Twitter did worse, though, giving us all those years without being able to edit your OWN posts. Yeah, there was value in it, being able to prove what someone said and when. But people became so dependent on that proof that we still sometimes see posts on other sites, like here on Tumblr, getting attention for being prophetic when they were actually edited after the fact, because people no longer even consider the possibility of a post being edited.


I don't have a solution for the problem. Just saying, the viewpoint of someone who entered online fandom in the 90's and 00's is a bit of a different perspective on this.

anyone curious about how my writing style works, here's one tidbit


I have an "Unkilled Darlings" folder


Passages that I love, but either


1. I had to remove from a piece of writing they didn't fit in, or


2. they sprang fully formed from my head with no context, and need to wait until I start a piece of writing worthy of them


My Kirk/Spock story "Savage-Wild" has two parts that began life in the Unkilled Darlings folder (the part about Vulcan euphemisms and the part about hardness-related analogy)


Here's another that doesn't have a home yet:

I relate so very, very strongly to Sei Shonagon, even though my writing is much more... maximalist than hers.


because I, too, put meaning and connection and wordplay into every part of what I write


AND I've got her same two warring inner demons: "Make it subtle, so it takes effort to understand!" and "I will be fuckin pissed off if people do not understand!"


I think if Sei Shonagon could see the present day she'd be: 1. THRILLED that biographers are analyzing and annotating her poetry a thousand years later but also 2. ENRAGED at how many of her brilliant clever little insights are going over everyone's stupid head (because y'know a thousand years does wear away a lot of context)

This reference would have been particularly striking to the maybe 2 or 3 people in her audience familiar with that poem, which was written at least 50 fucking years before any of them were born."
