i think the legal question would come down to the difference between owning pet chipmunks and just having chipmunks decide to live in your house. There are laws against pet squirrels in most parts of the US so there’s probably one about chipmunks too…

BUT if the chipmunks are free to come and go, and are just deciding to live with him, then I think, legally speaking, he just has a rodent infestation.

(Which he also probably could be mandated to stop, if law enforcement inspected the house, but it depends. If there are only six… well I know people who’ve gone on with their lives for many years with definitely more than six rodents living in their walls.)
